The U.S. Supreme Court ruled unanimously that naturally occurring human genes cannot be patented, handing the plaintiffs in Association for Molecular Pathology v. Myriad Genetics a huge victory. The June 13 decision means that Myriad cannot control all testing or other work using two genes linked to a higher risk of breast and ovarian cancer. The ACLU was a pro bono attorney in the case, which also included as plaintiffs the American College of Medical Genetics, American Society for Clinical Pathology and other groups and individuals.
