CEO DATELINE - Beverage association lawsuit heading to Pennsylvania Supreme Court

The Pennsylvania Supreme Court will hear a lawsuit brought by the American Beverage Association against Philadelphia's new soda tax, the news site Quartz reported.
Philadelphia's city council enacted a 1.5-cent-per ounce tax on surgery and diet beverages in 2016. The vote was a policy blow to ABA, which had been mostly successful in stopping cities and states from creating "soda taxes" up to that point.
Passage of the tax set off a costly legal battle between the city and beverage industry, but so far ABA and industry proponents have had no success in convincing courts to overturn the law.
The state supreme court agreed to take up ABA's appeal of a lower court decision Jan. 30, according to Quartz.
If justices uphold the law, the decision could be a major blow to efforts to prevent other communities across the U.S. from enacting their own soda taxes. http://bit.ly/2nLVA1A
At least six communities, including Philadelphia, collected soda taxes as of September 2017, according to website The Balance. However, Cook County in Illinois--home of Chicago--recently decided to end its 1-cent-per ounce tax after it failed to generate the revenues proponents had expected.
